These Terms of Service ("Terms") constitute a legally binding agreement between NestCraft Innovations Pvt. Ltd. ("NestCraft", "we", "us", or "our") and any natural or legal person ("you" or "Customer") accessing or using our web application, mobile interfaces, APIs, or related digital experiences (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and applicable Indian laws, including the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023 ("DPDP Act").
1. Eligibility & Account Responsibilities
You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. You agree to provide accurate account information and maintain the confidentiality of your login credentials. You are responsible for all activities carried out under your account. Notify us promptly at support@nestcraft.studio if you suspect unauthorized access.
2. Description of Services
NestCraft provides AI-powered interior design concept generation, product recommendations, collaboration tools, and subscription plans intended for inspiration and planning purposes. We may add, modify, or discontinue features to comply with law, improve user experience, or address security concerns. Non-material changes will be notified via in-product alerts or email.
3. Subscription Plans, Fees & Billing
- Paid plans are billed in Indian Rupees (INR) through Razorpay Software Private Limited.
- Applicable Goods and Services Tax (GST) is levied in accordance with the CGST Act, 2017.
- Payments are non-transferable and, except as outlined in the Refund & Cancellation Policy, non-refundable.
- Failure to complete payment may result in suspension of premium features.
- We may revise plan pricing with at least 15 days' prior notice via email or in-app notification.
4. Use of AI-Generated Outputs
AI-generated concepts are illustrative representations. They may not reflect structural feasibility, material availability, or regulatory compliance. You must independently validate measurements, on-site conditions, and statutory approvals. NestCraft is not liable for construction or execution outcomes.
5. User Content & Acceptable Use
You retain ownership of images, prompts, or materials you upload. By submitting content, you grant NestCraft a non-exclusive, worldwide, royalty-free licence to host, process, and analyse such content strictly to provide the Services. You agree not to upload content that is unlawful, defamatory, obscene, infringing, or violates the SPDI Rules or any applicable Indian law.
6. Intellectual Property
All intellectual property in the Services—including software code, models, branding, and user interface—is owned by or licensed to NestCraft and protected under the Copyright Act, 1957 and the Trademarks Act, 1999. No rights are granted beyond the limited, revocable licence necessary to use the Services. Reverse engineering, resale, or unauthorised exploitation is prohibited.
7. Third-Party Services
The Services may include links to third-party sites or tools (for example, e-commerce stores or design references). NestCraft does not endorse or control third-party content and is not responsible for external terms or privacy policies. Your dealings with third parties are solely between you and such third parties.
8. Data Protection & Privacy
NestCraft processes personal data in accordance with the Privacy Policy, the SPDI Rules, and the DPDP Act. By using the Services, you consent to our collection and use of information for lawful purposes, including account management, analytics, and compliance.
9. Warranty Disclaimer
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, NestCraft disclaims all warranties, whether express, implied, statutory, or otherwise—including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted under Indian law, NestCraft, its officers, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, or data. Our aggregate liability in any circumstance shall not exceed the subscription fees paid by you in the preceding three (3) months.
11. Indemnification
You agree to indemnify and hold harmless NestCraft and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your misuse of the Services or breach of these Terms or applicable law.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Subject to the arbitration clause below, courts in Bengaluru, Karnataka shall have exclusive jurisdiction. Disputes unresolved through mutual discussion within 30 days shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator appointed by NestCraft, the seat shall be Bengaluru, and proceedings shall be in English.
13. Changes to Terms
We may update these Terms periodically. Material changes will be notified via email or prominent in-product notices. Continued use of the Services after the effective date of changes constitutes acceptance of the revised Terms.
